1. Introduction
This Risk Disclosure statement is provided by Northmark Analytics Inc., operating under the brand name Orbix Firm (“Company,” “we,” “us,” or “our”), to ensure that you fully understand the risks associated with using our platform at https://orbixfirm.com/ (the “Platform”).
Please read this document carefully before purchasing a Challenge or using the Platform. By proceeding, you acknowledge that you have read, understood, and accepted the risks described below.
Capitalized terms not defined here have the meanings set forth in our Terms of Service.
2. Nature of the Service
Orbix Firm is a skill-based performance evaluation service. Users pay a one-time Challenge Fee to access a simulated Evaluation in which they place Predictions on real sporting events, tracked against real outcomes, within defined risk parameters.
Important clarifications:
- The Platform is not a gambling service, sportsbook, or betting exchange
- You do not wager real money on sporting outcomes
- Virtual Balances are not real money and have no cash value outside the Evaluation context
- Challenge Fees are payment for the evaluation service, not stakes, wagers, or investments
- Performance Payouts are rewards for demonstrated analytical skill, paid from Company operating revenue
3. Financial Risks
3.1 — Challenge Fees Are Non-Refundable
Challenge Fees are non-refundable once your Evaluation has started (defined as placing your first Prediction). You should treat the Challenge Fee as a cost of accessing the evaluation service, not as an investment with an expected return.
3.2 — No Guarantee of Payouts
Passing an Evaluation and earning Performance Payouts is not guaranteed. The majority of Users do not pass their Evaluations. You should not purchase a Challenge with the expectation of earning a payout.
Do not spend money on Challenge Fees that you cannot afford to lose.
3.3 — Past Performance Does Not Guarantee Future Results
Success in one Evaluation does not guarantee success in future Evaluations or on a Funded Account. Market conditions, available sporting events, odds, and your own analytical performance may vary over time.
3.4 — Funded Account Revenue Is Not Guaranteed
Qualifying for a Funded Account does not guarantee ongoing income. Your Funded Account may be revoked if you violate Platform rules, and the Company reserves the right to modify Funded Account terms with notice as described in the Terms of Service.
3.5 — Currency & Exchange Rate Risk
All Challenge Fees, Virtual Balances, and Performance Payouts are denominated in United States Dollars (USD). If your local currency is not USD, you bear the risk of exchange rate fluctuations when:
- Paying Challenge Fees (conversion handled by your payment provider or Paddle)
- Receiving Performance Payouts (conversion handled by your payout provider)
The Company is not responsible for any losses resulting from currency conversion or exchange rate changes.
4. Platform & Technical Risks
4.1 — Platform Availability
The Platform is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation. The Platform may experience:
- Scheduled maintenance and downtime
- Unplanned outages due to technical failures
- Degraded performance during high-traffic periods
- Service interruptions caused by third-party infrastructure providers
Predictions cannot be placed, modified, or cancelled during periods of downtime. Active Evaluations continue to run during outages — drawdown limits and daily loss limits are not paused or reset due to downtime.
4.2 — Third-Party Data Accuracy
The Platform relies on third-party providers (including The Odds API) for sporting event data, odds, and results. We do not control these data sources and cannot guarantee their accuracy, completeness, or timeliness.
Risks include:
- Odds discrepancies: Odds displayed on the Platform may differ from odds available on other platforms
- Delayed results: Settlement of Predictions depends on timely receipt of results from data providers
- Data errors: Incorrect scores, event times, or market data may occasionally occur
- Missing events: Some sporting events or markets may not be available
The Company will make reasonable efforts to resolve data discrepancies, but Evaluation results that are affected by third-party data issues will generally stand unless the Company determines, at its sole discretion, that a correction is warranted.
4.3 — Automated Evaluation
Evaluation pass/fail decisions are made automatically by the Platform based on predefined rules. While these rules are transparent and consistently applied, automated systems may not account for extraordinary circumstances. If you believe an automated decision was made in error, you may contact support@orbixfirm.com for review.
5. Rule & Policy Risks
5.1 — Rules May Change
The Company reserves the right to modify Evaluation rules, Challenge pricing, payout terms, profit split ratios, and other Platform parameters with notice as described in the Terms of Service (30 days for material changes).
Changes will not retroactively affect Evaluations that are already in progress at the time of the change, but will apply to new Challenges purchased after the effective date.
5.2 — Funded Account Terms May Be Modified
Funded Account terms — including profit split ratios, risk parameters, and payout processing — may be modified with notice. Continued use of a Funded Account after the notice period constitutes acceptance of the new terms.
5.3 — Account Suspension or Termination
Your Account, Evaluations, or Funded Account may be suspended or terminated if you violate the Terms of Service or Acceptable Use Policy. Termination for cause results in forfeiture of pending payouts and no refund of Challenge Fees. See our Terms of Service and Acceptable Use Policy for details.
6. Tax & Legal Risks
6.1 — Tax Responsibility
You are solely responsible for determining and fulfilling your tax obligations related to Challenge Fee payments and Performance Payouts. This includes but is not limited to:
- Income tax on Performance Payouts
- Value-added tax (VAT) or goods and services tax (GST) on Challenge Fees
- Reporting requirements in your jurisdiction
- Any other applicable taxes or levies
The Company does not provide tax advice and is not responsible for withholding taxes on your behalf unless required by applicable law. You should consult a qualified tax professional in your jurisdiction.
6.2 — Regulatory Risk
The regulatory environment for platforms like Orbix Firm varies by jurisdiction and may change over time. There is a risk that:
- Regulatory changes in your jurisdiction may affect your ability to use the Platform
- The Company may be required to restrict access from additional jurisdictions
- New laws or regulations may impose additional requirements on the Platform or its Users
The Company monitors regulatory developments but cannot guarantee continued availability of the Platform in any specific jurisdiction.
6.3 — Jurisdictional Compliance
You are responsible for ensuring that your use of the Platform complies with all applicable laws in your jurisdiction. The Platform is not available to Users in Canada, the United States, or sanctioned countries as specified in the Terms of Service.
7. Responsible Participation
We encourage all Users to approach the Platform responsibly:
- Set a personal budget for Challenge Fees and do not exceed it
- Do not borrow money to purchase Challenges
- Do not treat Challenges as investments — treat them as a cost for a skill evaluation experience
- Take breaks if prediction activity is causing stress or financial strain
- Understand the rules thoroughly before purchasing a Challenge — review the Rules page and this Risk Disclosure in full

8. Acknowledgment
By purchasing a Challenge or using the Platform, you acknowledge that:
- You have read and understood this Risk Disclosure in its entirety
- You understand that Challenge Fees are non-refundable once an Evaluation has started
- You understand that earning Performance Payouts is not guaranteed
- You are not spending money that you cannot afford to lose
- You accept the technical, financial, regulatory, and other risks described above
- You are solely responsible for your tax obligations
- You have not relied on any representation or guarantee of earnings from the Company or its representatives
